1. Introduction

Welcome to ChrisDesign.Work. These terms and conditions outline the rules and regulations for the use of my services. By accessing my services, you accept these terms and conditions in full. Do not continue to use my services if you do not accept all of the terms and conditions stated on this page.

2. Intellectual Property Rights

Unless otherwise stated, the intellectual property rights for all material created through my services belong to the paid customer. You may view and/or print materials for your own personal use, subject to restrictions set in these terms and conditions.

3. Restrictions

You are specifically restricted from all of the following:

• Publishing any material created through my services in any other media without permission.
• Selling, sublicensing, and/or otherwise commercializing any material created through my services.
• Publicly performing and/or showing any material created through my services.
• Using my services in any way that is or may be damaging to my reputation.
• Using my services in any way that impacts other users’ access to my services.
• Using my services contrary to applicable laws and regulations, or in any way that may cause harm to my business, or to any person or business entity.
• Engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to my services.
• Using my services to engage in any advertising or marketing without permission.

4. Payments and Retainers

All payments for my services are due as specified in the invoice provided. A retainer fee may be required to secure my services, which will be outlined in the service agreement. The retainer fee is non-refundable and will be applied towards the total cost of the project. Full payment must be received before the final delivery of the project. Failure to make timely payments may result in a delay or cancellation of services.

5. No Warranties and Refunds

My services are provided “as is,” with all faults, and I express no representations or warranties, of any kind related to my services or the materials created through my services. Also, nothing contained in my services shall be interpreted as advising you.

Refunds are provided at my discretion and are evaluated on a case-by-case basis. If you are not satisfied with a service or product, please contact me within 30 days of purchase to discuss a potential refund.

6. Limitation of Liability

In no event shall I, nor any of my officers, directors, and employees, be held liable for anything arising out of or in any way connected with your use of my services whether such liability is under contract. I, including my officers, directors, and employees shall not be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of my services.

7. Indemnification

You hereby indemnify to the fullest extent me from and against any and/or all liabilities, costs, demands, causes of action, damages, and expenses arising in any way related to your breach of any of the provisions of these terms.

8. Severability

If any provision of these terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

9. Variation of Terms

I am permitted to revise these terms at any time as I see fit, and by using my services you are expected to review these terms on a regular basis.

10. Assignment

I am allowed to assign, transfer, and subcontract my rights and/or obligations under these terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these terms.

11. Entire Agreement

These terms constitute the entire agreement between me and you in relation to your use of my services and supersede all prior agreements and understandings.

12. Governing Law & Jurisdiction

These terms will be governed by and interpreted in accordance with the laws of the State of Florida, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Florida for the resolution of any disputes.
